Terms of Use

1. Agreement

By accessing or using the Employment Compass client portal ("the Portal"), you agree to be bound by these Terms of Use. If you do not agree, you must not use the Portal. These terms form part of your service agreement with Employment Compass Pty Ltd (ABN 52 621 421 112).

2. Services

The Portal provides access to HR management tools including:

• Employee record management and compliance monitoring
• Contract generation and digital signing
• Document storage and processing
• Payroll integration and reconciliation
• WHS incident and hazard management
• Training and qualification tracking
• Policy and handbook generation
• Advisory booking and communication

Services are provided as part of your Employment Compass advisory subscription. Feature availability depends on your plan tier.

3. User Accounts

• You are responsible for maintaining the confidentiality of your login credentials
• You must not share your account or allow unauthorised access
• You must notify us immediately of any suspected unauthorised use
• Account access is granted based on role-based permissions set by your organisation administrator
• We reserve the right to suspend accounts that violate these terms

4. Acceptable Use

You agree not to:

• Use the Portal for any unlawful purpose
• Upload malicious files, scripts, or content
• Attempt to gain unauthorised access to other accounts or systems
• Interfere with or disrupt the Portal's operation
• Reverse-engineer, decompile, or attempt to extract source code
• Use automated tools to scrape or extract data without authorisation
• Share confidential employee information outside authorised channels

5. Data & Content

Your data: You retain ownership of all data you upload or create in the Portal. We process your data solely to provide the agreed services.

Our content: All Portal content, including templates, guides, and generated documents, is provided for your internal business use. Templates are based on Australian employment law but may require customisation for your specific circumstances.

6. Intellectual Property

The Portal, including its design, code, features, and documentation, is the intellectual property of Employment Compass Pty Ltd. Your subscription grants a non-exclusive, non-transferable licence to use the Portal for your internal business purposes. You may not reproduce, distribute, or create derivative works from the Portal.

7. Advisory Disclaimer

Information provided through the Portal, including AI-generated content, compliance alerts, and document templates, is general in nature and does not constitute legal advice. While we base our guidance on current Australian employment legislation and Modern Awards, you should seek independent legal advice for complex or contentious matters. Employment Compass is not a law firm.

8. Service Availability

We aim to maintain Portal availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable notice. We are not liable for disruptions caused by factors outside our control, including internet outages, third-party service failures, or force majeure events.

9. Limitation of Liability

To the maximum extent permitted by law, Employment Compass's total liability for any claim arising from your use of the Portal is limited to the fees paid by you in the 12 months preceding the claim. We are not liable for indirect, consequential, or incidental damages, including lost profits or data loss. Nothing in these terms excludes or limits liability that cannot be excluded under Australian Consumer Law.

10. Termination

Portal access is tied to your Employment Compass service agreement. Upon termination of your subscription, your Portal access will be revoked. You may request export of your data within 30 days of termination. After this period, data will be deleted in accordance with our retention policy, subject to legal record-keeping obligations.

11. Governing Law

These terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.

12. Changes to Terms

We may update these terms from time to time. Material changes will be notified through the Portal or via email at least 14 days before taking effect. Continued use of the Portal after changes constitutes acceptance.
